1.1 Welcome to ECCO Club, the membership program (hereinafter the “Membership”) of ECCO Shoes Canada, Inc., with its registered address at 50 Carroll Street, Toronto, Ontario M4M 3G3, and company registration number Ontario 991664, and its subsidiaries (hereinafter “ECCO”). Canada shall be the territory relevant for the Membership (hereinafter the “Territory”). By signing up for the Membership, you agree to be bound by these Terms and Conditions for ECCO’s membership program in the Territory (hereinafter the “Terms and Conditions”).
2.1 Participation in the Membership is limited to individuals residing in the Territory and acting in their personal capacity with a valid email account. To participate, you must have reached the age of majority in your province or territory of residence. By signing up, you confirm that you meet these eligibility criteria. ECCO reserves the right to request written confirmation that you meet these eligibility criteria but is not obligated to do so.
2.2 Companies, foundations, associations, or other entities, as well as individuals making bulk or commercial purchases, are not eligible to participate.
3.1 If you meet the above eligibility criteria, you may sign up by completing and submitting the registration form at ca.ecco.com/campaigns/ecco-club, through the ECCO website at ca.ecco.com/create-account, or in ECCO’s Canadian retail stores. Enrollment is free of charge and not conditional upon making a purchase.
3.2 Only one account is permitted per person. Your participation in the Membership is personal and non-transferable. The Membership may not be used for resale or for profit. It is your responsibility, and a condition for participation, to keep your email address and contact details up to date. You must also use your best efforts to keep your email address and password secure and confidential, and you are responsible for all activity conducted through your account.
4.1 The Membership is our way of thanking and rewarding our loyal customers. Benefits may include, but are not limited to, the following (please note that some benefits are delivered by email and are only available if you are subscribed to marketing emails; see sections 4.6 and 5.2 below for additional information):
A welcome discount for signing up for our newsletter, which may be used on your first full-price purchase as an ECCO Club member.
Coupons: upon completing your first purchase as an ECCO Club member, on the anniversary of your enrollment, and on your birthday, you may receive coupons that can be applied to eligible footwear purchases.
Everyday Benefits, including free standard shipping on all orders and free returns within 30 (thirty) days on eligible purchases.
Exclusive Access and Personalized Discounts: As an ECCO Club member, you may from time to time receive early access to new arrivals (e.g., shop seasonal drops before general release) or early access to sales (e.g., advance access to Black Friday promotions), as well as personalized discounts tailored to your past purchases and engagement.
Exclusive Invitations: As an ECCO Club member, you may receive invitations to exclusive VIP discount events, as well as exclusive access to in-store events and brand experiences.

4.2 Coupons received through ECCO Club are valid for 30 calendar days from the date of receipt and cannot be combined with other coupons. Vouchers may only be applied to purchases of eligible footwear and may be redeemed online at ca.ecco.com (while logged into your account) or in-store at ECCO-owned and operated Canadian retail stores and outlets (ECCO wholesale partners are excluded). Coupons are generally valid for single use only and for a limited time. Promotional discounts will not be reissued or honored after the offer period has expired.
4.3 Transition rewards for existing ECCO accounts: If you held an ECCO account prior to enrolling in ECCO Club, your Membership rewards will depend on whether you were previously subscribed to the ECCO newsletter and whether you are subscribed to marketing emails at the time of enrollment in ECCO Club. Past newsletter subscriptions and associated benefits do not carry over to the ECCO Club program.
4.4 If you return items purchased using a coupon, ECCO will refund (or, where applicable, issue a credit note for) the amount actually paid after application of the coupon. ECCO may, at its discretion and as permitted by law, either (a) deem the voucher used and not reinstate it, or (b) reinstate or reissue the coupon, subject to its original expiration date.
4.5 Abuse and multiple sign-ups safeguards: To protect the integrity of the Membership, each individual is limited to one account. ECCO may also limit one account per email address, mobile number, payment card, shipping address, and/or household. Creating, using, or attempting to use multiple accounts, or repeatedly enrolling in and cancelling Memberships to obtain additional benefits, is prohibited and constitutes abuse. ECCO may require identity verification, aggregate related accounts, deny or revoke benefits, cancel orders, suspend or terminate accounts, and take any other action it deems appropriate if it detects or reasonably suspects abuse, fraud, or misuse of the Membership program.
4.6 Coupon delivery and marketing subscription: Coupons and other benefits are delivered by email to the address associated with your ECCO Club account. Certain benefits that are promotional in nature (such as coupons and invitations to VIP events) - are distributed as part of ECCO marketing emails. Accordingly, to receive these benefits, you must be subscribed to ECCO marketing emails. If you unsubscribe, you will continue to receive essential service communications related to your Membership; however, you will no longer receive marketing communications and, as a result, may not receive coupons or invitations delivered via email. ECCO is not responsible for any coupons or emails that are blocked, filtered, misdirected, or not received due to inaccurate or outdated contact information.
4.7 For in-store purchases, you must inform store staff of your Membership enrollment and provide your account information (name and email address) so that benefits can be properly applied. Only purchases made at ECCO retail stores within the Territory will qualify. Purchases made outside the Territory, including during travel to other countries, are not eligible under this Membership.
4.8 Personalized benefits and discounts are automatically generated based on the personal data we process about you, such as your gender, age, and information about your interests and purchasing preferences, as further described in our Privacy Policy (see Section 6 of these Terms and Conditions).
The Membership is provided on an “as is” and “as available” basis. ECCO may, in its sole discretion, from time to time, change, discontinue, or add Membership-related benefits and activities without prior notice to you. For a list of currently available Membership benefits, please refer to ca.ecco.com/campaigns/ecco-club.
4.9 Benefits may not be used or redeemed in combination with other discounts or promotions and cannot be exchanged for other benefits, cash, gift cards, products, or other goods or services.
5.1 Membership Communications: By enrolling in the Membership, you agree that ECCO may send you service communications via email, text messages (SMS), and/or postal mail to provide information necessary for the operation of the Membership (for example, enrollment confirmations, account and benefit status, and updates to these Terms and Conditions).
5.2 Marketing communications and delivery of promotional benefits: Some Membership benefits are delivered via marketing emails (including the welcome offer, birthday coupon, anniversary coupon, and invitations to VIP and early-access events). You must subscribe to, and remain subscribed to, ECCO marketing emails to receive these benefits. You may withdraw your marketing consent at any time by using the unsubscribe link in our emails; doing so will not affect service communications but may prevent the delivery of marketing emails and related benefits.

6.1 For the purpose of your participation in the Membership, ECCO will collect and process personal data about you, such as your name, email address, and any other personal data you provide to ECCO. 7.1 Your termination: You may terminate your Membership at any time by contacting ECCO Customer Service at eccocanada@ecco.com.
7.2 ECCO’s termination: ECCO may terminate your Membership at any time if we determine that you (a) are ineligible to enroll or participate (see Section 2 above), (b) have violated any of these Terms and Conditions, any other ECCO terms and conditions applicable to the Membership (e.g., website Terms of Use or Terms and Conditions of Sale), or any applicable law or regulation, or (c) have engaged in any fraud, deception, or abuse of the Membership or any of the benefit programs provided to members.
7.3 Consequences of termination: Regardless of the reason for termination, your Membership will be revoked, and any benefits in your account will automatically expire and be forfeited. Your access to the Membership will also be terminated.
7.4 Changes to and discontinuation of the Membership: The Membership and its benefits are offered at ECCO’s sole discretion. Subject to applicable law (which may include the Province of Quebec), ECCO reserves the right to terminate, cancel, discontinue, suspend, modify, or otherwise change the Membership, any part, aspect, or feature of the Membership, and/or these Terms and Conditions at any time without prior notice. However, to the extent such changes affect coupons already received (subject to applicable law, which may include the Province of Quebec), ECCO will provide prior notice (via email) of such changes. In the event you disagree with any such changes, you may terminate your Membership.
8.1 The Membership and all associated text, audio, video, pictures, music, images, graphics, information, data, content, and other materials displayed on or downloadable through the Membership and/or the ECCO website (collectively, the “Content”) are the property of, or used with permission by, ECCO (or its affiliates). Such Content is protected by copyright, trademark, and other applicable laws and may not be used except as permitted in connection with your Membership or with the prior written consent of the owner. You may not modify the Content in any way or reproduce, publicly display, perform, distribute, or otherwise use any Content for any public or commercial purpose. Any unauthorized use of Content may violate copyright laws, trademark laws, privacy and publicity laws, or other applicable laws, rules, and regulations. You may not remove any copyright, trademark, or other proprietary notices from the Membership, the ECCO website, or any Content. All rights in the Content not expressly granted herein are reserved by the respective owners.
8.2 Certain trademarks, trade names, service marks, logos, icons, and domain names used or displayed on or through the Membership and/or the ECCO website are registered or unregistered trademarks, trade names, and service marks owned by ECCO and/or its affiliates. Other trademarks, trade names, and service marks used or displayed are owned by their respective owners and are used with permission by ECCO. Nothing contained in these Terms and Conditions, the Membership, or on the ECCO website grants, or shall be construed as granting, by implication, estoppel, or otherwise, any license or right to use any such trademarks, trade names, service marks, or logos without ECCO’s prior written consent or the prior written consent of the applicable third-party owner.
9.1 Certain of the following limitations and exclusions may not apply to you to the extent that applicable law (which may include the Province of Quebec) does not permit such limitation or exclusion.
9.2 Except to the extent prohibited by applicable law (which may include the Province of Quebec), ECCO disclaims all warranties and conditions of any kind. You acknowledge and agree that neither ECCO nor any of its parent companies, subsidiaries, affiliates, or partners shall be responsible or liable for any (a) loss or damage arising from your use of the Membership and/or from any suspension, discontinuation, modification, or similar change to the Membership, (b) inaccuracies or omissions in the Membership or its content; (c) interruptions to the Membership, including access delays or disruptions; and/or (f) your use of, or participation in, Membership activities, including the events described in Section 4.1 above.
9.3 Except to the extent prohibited by applicable law (which may include the Province of Quebec), neither ECCO nor any of its parent companies, subsidiaries, affiliates, or partners shall be liable for any indirect, special, incidental, punitive, or consequential damages of any kind arising from or related to the Membership or your participation therein. In all cases, ECCO’s total liability shall be limited to CAD $100 (one hundred dollars).
10.1 ECCO’s failure to enforce, or delay in enforcing, any of its rights under these Terms and Conditions shall not constitute a waiver of such rights and shall not affect the validity or interpretation of these Terms and Conditions. If any court or competent authority determines that any provision of these Terms and Conditions is unlawful or unenforceable, the remaining provisions shall remain in full force and effect.
11.1 Subject to applicable law (which may include the Province of Quebec), the Membership and these Terms and Conditions shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without giving effect to any conflict of law principles. A printed version of these Terms and Conditions shall be admissible in judicial and administrative proceedings based upon or relating to these Terms and Conditions to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
12.1 All other rights relating to purchases are set out in the Terms of Use. In all matters not governed by these Terms and Conditions and the Sales and Delivery Conditions, the applicable laws and regulations of the Territory shall apply.
